Service inquiries include the business details you submit and available campaign source tags. We use these records to assess fit, coordinate follow-up, and respond to your request. Client campaign information is also handled according to the agreed engagement.
Public follow-up assessment
The public follow-up assessment calculates a recommendation in your browser using your selected answers, not an AI audit of your business. Answers are not submitted unless you request an emailed action plan. Analytics may record assessment starts and completions, but those events do not include your answers or email address.
If you request a plan, we save your answers, email address, optional name, service-contact preference, and campaign attribution to deliver it and manage the request. Requesting a plan does not subscribe you to a newsletter. We follow up about managed services only when you select that option or separately make an inquiry.
The lightweight public lead-capture store schedules records for deletion after 90 days; deletion is not instantaneous. Recovery backups and email correspondence can remain subject to our broader retention practices below. Security rate limits use short-lived hashes rather than storing raw IP addresses in lead records. Contact us to request access or deletion.

5. Legal bases where applicable
Where privacy laws require a legal basis for processing, we rely on one or more of the following: performance of a contract; legitimate interests such as providing, securing, improving, and marketing the Service; consent where required; compliance with legal obligations; and protection of rights, safety, and security.
When we process Customer Data as a processor or service provider, the customer is responsible for identifying and maintaining the appropriate legal basis, notices, consents, opt-outs, and instructions for that Customer Data.
6. AI-assisted processing
AI-assisted features may process Customer Data, prompts, instructions, files, campaign materials, business context, and generated outputs through AmpTrend systems and selected service providers. We use these features to provide drafting, recommendations, analysis, summarization, workflow support, and related Service functionality.
For campaign-generation workflows, AI-assisted processing may include visual references, brand constraints, proof points, captions, video shot timelines, source images, generated clips, provider job IDs, webhook or polling status, safety findings, cost estimates, review states, and approval metadata.
AI-generated results may be inaccurate, incomplete, biased, outdated, non-unique, or unsuitable for a specific purpose. Customers and users are responsible for reviewing and approving outputs before using them in campaigns, communications, decisions, or external publications.
Do not submit sensitive personal information, regulated data, confidential third-party information, or data you are not authorized to process unless your agreement with AmpTrend permits it and appropriate safeguards are in place.
7. How we disclose information
Service providers and subprocessors
We may disclose information to vendors and service providers that help us host, secure, monitor, analyze, bill, support, communicate, authenticate, develop, and operate the Service. These may include cloud hosting providers, AI providers, analytics providers, payment processors, communications providers, customer support tools, security tools, and professional advisors.
Customer-directed integrations
When you enable integrations or request actions involving third-party platforms, we disclose and receive information as needed to perform those actions. The third-party platform's terms and privacy practices apply to its processing.
Within customer organizations
Account administrators and authorized users may access information associated with their organization, workspace, roles, campaign workflows, usage, logs, reports, and connected integrations.
Legal, safety, and enforcement
We may disclose information when we believe doing so is required or appropriate to comply with law, legal process, governmental requests, security obligations, audits, investigations, enforcement of agreements, prevention of harm, or protection of rights, safety, property, and service integrity.
Business transactions
We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, due diligence process, or similar business transaction.
Aggregated or de-identified information
We may disclose aggregated, anonymized, or de-identified information for analytics, benchmarking, research, product development, security, marketing, and business purposes where permitted by law.
8. Sale, sharing, and targeted advertising
We do not sell personal information in the common meaning of that term. We also do not use Customer Data submitted to the Service for cross-context behavioral advertising unless a customer expressly enables a feature that requires such processing and applicable notices, consents, and opt-outs are in place.
Some privacy laws define "sale," "share," or "targeted advertising" broadly. If our activities are considered a sale, sharing, or targeted advertising under applicable law, we will provide required notices and choices.
9. Customer Data and customer obligations
Customers are responsible for the personal information they submit to the Service and for their use of outputs, integrations, campaign workflows, and communications. Customers must provide required notices, obtain required consents, maintain opt-out mechanisms, honor privacy rights, maintain lawful data sources, and ensure that their instructions to AmpTrend comply with applicable law.
If you are an individual whose information has been processed by one of our customers through the Service, please contact that customer directly for privacy requests related to its Customer Data. We will assist customers with those requests as required by applicable agreements and law.
10. Marketing communications and opt-outs
AmpTrend may send administrative, security, billing, support, and service-related communications that are necessary for the Service. We may also send marketing communications where permitted by law. You may opt out of marketing emails by using the unsubscribe link or contacting us, but you may still receive non-marketing Service communications.
Customers using the Service for their own email, SMS, push, advertising, retargeting, or other marketing programs are responsible for complying with applicable consent, disclosure, opt-out, sender identification, do-not-call, anti-spam, and platform requirements.
11. Retention
We retain personal information for as long as reasonably necessary to provide the Service, maintain accounts, fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and support business operations.
Retention periods vary based on the type of information, account status, customer instructions, contractual commitments, legal requirements, security needs, backup schedules, and legitimate business purposes. We may retain Usage Data, security logs, billing records, audit records, and aggregated or de-identified information for longer periods where permitted by law.
Customer administrators may have controls to delete or export certain Customer Data. Deletion may not immediately remove information from backups, logs, archives, legal holds, or systems where retention is required or permitted.
12. Security
We use administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, disclosure, alteration, and destruction. These safeguards may include access controls, authentication, encryption in transit, logging, monitoring, vendor review, least-privilege practices, and incident response procedures.
No method of transmission, storage, or processing is completely secure. Customers are responsible for configuring accounts, managing users, protecting credentials, limiting access, securing endpoints, reviewing integrations, and maintaining appropriate internal policies.
13. International transfers
AmpTrend may process and store information in the United States and other locations where we or our service providers operate. These locations may have privacy laws different from those in your jurisdiction.
Where required, we use appropriate safeguards for international transfers, such as contractual protections, data processing terms, and other mechanisms recognized by applicable law.
14. Children
The Service is intended for business use and is not directed to children under 13 or to individuals under the age required by applicable law to use online business services. We do not knowingly collect personal information from children through the Service. If you believe a child has provided personal information to us, contact privacy@amptrend.com.
15. Privacy rights and choices
Depending on your location and relationship with AmpTrend, you may have rights to request access, correction, deletion, portability, restriction, objection, withdrawal of consent, opt-out of certain processing, or appeal of a privacy-rights decision. These rights may be limited by law, security, identity verification, our role as processor or service provider, and our need to retain information for legitimate purposes.
To submit a request, contact privacy@amptrend.com. We may need to verify your identity, confirm your authority, or direct you to the applicable customer when the request concerns Customer Data processed on that customer's behalf.
16. California privacy notice
This section supplements the Policy for California residents. We may collect the categories of personal information described in this Policy, including identifiers, commercial information, internet or electronic activity information, geolocation derived from IP address, professional or employment-related information, audio or visual information if submitted in support interactions, inferences, and sensitive personal information such as account credentials or precise information only where submitted or required for the Service.
We collect personal information from the sources described above and use it for the business and commercial purposes described in this Policy. We disclose personal information to service providers, subprocessors, integrations you direct, customer administrators, legal and safety recipients, and business transaction parties as described above.
California residents may have rights to know, access, correct, delete, opt out of sale or sharing, limit certain uses of sensitive personal information, and not be discriminated against for exercising rights. We do not knowingly sell or share personal information of individuals under 16.

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice by posting the updated Policy, changing the effective date, sending a notice through the Service, or using another reasonable method. Continued use of the Service after the updated Policy becomes effective means the updated Policy applies to information processed after that date, subject to applicable law.
20. Contact
Questions, privacy requests, or data protection inquiries may be sent to privacy@amptrend.com. Please include your name, organization, account email, jurisdiction, the nature of your request, and enough information for us to evaluate and respond.
